The fate of intellectual property (IP) as it applies to commercialization is intricately connected to Patent prosecution decisions, and it can be sealed as early as the patent drafting stage. Understanding how patent law affects the scope of IP granted to the patentee and, consequently, the ability to commercialize the IP will inform inventors’ decision-making as early as experimental design, i.e., even prior to patent application filing.
